Right of cancellation

Consumers are entitled to the right of cancellation according to the following conditions, whereby a consumer is any natural person that concludes a transaction for purposes that can predominantly neither be allocated to its commercial nor independent professional activity.

Right of cancellation

You have the right to cancel this contract without giving any reason within a period of fourteen days.

The period of cancellation is fourteen days as of the day on which you or a third party that has been named by you and that is not the carrier took possession of the last goods.

To exercise your right of cancellation, you must inform us (mySPOTTi GmbH, Stampfgasse 6, 82229 Seefeld, Germany, Tel.: +49 8152-99858-70, email: info@myspotti.de) of your decision to cancel this contract by sending us an unambiguous declaration (e.g. by sending a letter by post or email). To do so, you may use the attached cancellation form template; however, this is not mandatory.

The deadline will be considered met if the notification stating that you are exercising your right of cancellation is sent before the cancellation period has lapsed.

 

Consequences of a cancellation

When you cancel this contract, we will reimburse you for any payments we have received from you, excluding delivery costs, immediately and at the latest within fourteen days as of the day on which we receive notification of your cancellation of this contract. For said reimbursement, we will use the same means of payment used in your original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement. We may refuse reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, depending on whichever date is earlier.

You must return or hand over the goods to us immediately and in any event within fourteen days as of the day on which you notified us of the cancellation of this contract. The deadline will be considered met if you dispatch the goods before the period of fourteen days has lapsed.

You will bear the immediate costs for returning the goods. The costs for returning goods that cannot be sent by regular post due to their nature are estimated at around €30.

You will only have to pay for the possible loss in value of the goods if this loss in value can be traced back to the goods being handled in a manner not necessary to check the nature, characteristics and functionalities of the goods.

 

Exclusion and/or premature lapse of the right of cancellation

The right of cancellation does not apply to contracts on the delivery of goods that are not prefabricated and the manufacture of which requires individual selection or specification by the consumer or that have clearly been tailored to the consumer’s personal needs.

The right of cancellation of contracts on the delivery of goods lapses prematurely if these have been inseparably mixed with other goods after delivery due to their nature. 

The right of cancellation does not apply to consumers that do not belong to a Member State of the European Union at the time of the conclusion of the contract and whose sole residence and delivery address are located outside the European Union at the time of the conclusion of the contract.

 

 

General Information

1) Please ensure goods are not damaged or dirty. Please return the goods in their original packaging along with any accessories and including all packaging components. Use protective outer packaging if necessary. If you no longer have the original packaging, please provide suitable packaging to ensure that the goods are sufficiently protected against damages caused by transport.

2) Please do not return the goods to us carriage forward.

3) Please note that the above mentioned items 1-2 are not a prerequisite for effectively exercising your right of cancellation.
